Welcome to Claimed, operated by Wondercat Studios ("we", "us", or "our"). By downloading, installing, or using the Claimed mobile application (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be at least 17 years of age to use the App. By creating an account, you represent and warrant that you meet this age requirement. We reserve the right to terminate accounts where we have reason to believe the user does not meet the minimum age.

2. Description of Service

Claimed is an entertainment application that provides AI-generated fictional content. You can interact with AI-powered characters through text-based conversations. All characters, storylines, and dialogue are entirely fictional and generated by artificial intelligence.

The App does not provide real relationship advice, therapy, counseling, or any professional guidance. Content generated by AI characters is for entertainment purposes only and should not be relied upon for personal, emotional, or health-related decisions.

3. Account and Conduct

You are responsible for maintaining the confidentiality of your account credentials. You agree not to:

Share your account with others.
Use the App for any unlawful purpose.
Attempt to reverse-engineer, decompile, or extract source code from the App.
Use automated tools, bots, or scripts to interact with the App.
Harass, abuse, or harm other users or our staff.

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms.

4. Subscriptions and Auto-Renewal

The App offers subscription plans that provide access to premium features. By subscribing, you agree to the following:

Auto-renewal: Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annually, depending on your selected plan) unless you cancel at least 24 hours before the end of the current period.
Billing: Payment is charged to your Google Play or Apple App Store account at confirmation of purchase. Renewal charges are billed within 24 hours prior to the end of the current period at the rate of the selected plan.
Cancellation: You can cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Price changes: We reserve the right to modify subscription pricing at any time. Price changes will take effect at the start of the next billing period following notice of the change. Continued use of the App after a price change constitutes acceptance of the new pricing.

5. Virtual Currency (Poison Hearts)

The App may offer a virtual currency called "Poison Hearts" that can be earned through gameplay or purchased with real money. By acquiring Poison Hearts, you acknowledge and agree that:

Poison Hearts have no real-world monetary value and cannot be exchanged for real currency, goods, or services outside the App.
Poison Hearts are non-refundable and non-transferable.
We reserve the right to modify the earning rate, pricing, and redemption value of Poison Hearts at any time.
Unused Poison Hearts may expire or be forfeited upon account termination.
Poison Hearts are a limited license, not a property right. We may revoke or adjust your balance at our discretion, including in cases of suspected fraud or abuse.

6. AI-Generated Content

All character interactions, dialogue, and narrative content within the App are generated by artificial intelligence. You acknowledge that:

AI-generated content is fictional and does not represent the views or opinions of Wondercat Studios.
Responses may sometimes be unpredictable, inaccurate, or inconsistent.
The App is not a substitute for real human relationships, professional therapy, or counseling.
We make no warranties regarding the quality, accuracy, or appropriateness of AI-generated content.

7. Intellectual Property

All content, characters, artwork, code, and other materials in the App are owned by or licensed to Wondercat Studios and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works based on our content without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Wondercat Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability to you for any claims arising from the use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Modifications to Terms

We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page and may notify you through the App. Your continued use of the App after any changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Romania.
